Terms of Service

1. Agreement to Terms

By accessing or using Guesto ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users of the Service, including property hosts, guests, and visitors.

2. Description of Service

Guesto is a vacation rental management platform that helps property hosts get direct bookings and build their guest database. Tools include:

  • Direct booking pages for your properties
  • Digital guest guides with QR codes
  • Guest CRM and database
  • Calendar sync with Airbnb, Booking.com, and others
  • Automated email campaigns
  • Booking inquiry management
  • Collect and respond to guest reviews
  • Custom branding and domains

3. Subscription and Payment

3.1 Free Trial

New users receive a 6-month free trial with full access to all features. No credit card is required to start the trial. During the trial period, you can use all features without limitation.

3.2 Subscription Plans

After your trial ends, you can continue using Guesto by subscribing to one of our plans based on your number of rooms/units:

  • Starter (1-3 rooms): €9 per month or €79 per year
  • Pro (4-15 rooms): €29 per month or €249 per year
  • Business (16-50 rooms): €79 per month or €679 per year

For properties with more than 50 rooms, please contact us for custom pricing.

3.3 Payment Processing

Payments are processed securely by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. You agree to provide accurate billing information.

3.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • Your subscription will remain active until the end of your current billing period
  • You will not be charged for subsequent periods
  • After your subscription expires, your account will become read-only
  • Your data will be retained for 90 days, after which it may be deleted

3.5 Refunds

We do not provide refunds for partial subscription periods. If you believe you have been charged in error, please contact us at billing@guesto.eu.

3.6 Price Changes

We reserve the right to change our prices. Any price changes will be communicated to you at least 30 days before they take effect and will apply to your next billing period.

4. Account Registration

To use certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

You must be at least 18 years old to create an account.

5. User Responsibilities

As a user of the Service, you agree to:

  • Use the Service only for lawful purposes
  • Comply with all applicable laws and regulations
  • Respect the privacy and rights of your guests
  • Provide accurate information about your properties
  • Obtain necessary consents before collecting guest data
  • Not use the Service to send spam or unsolicited communications
  • Not attempt to circumvent security measures
  • Not interfere with or disrupt the Service

6. Property Listings

When listing a property on Guesto, you represent and warrant that:

  • You have the legal right to offer the property for short-term rental
  • The property information you provide is accurate and not misleading
  • Your property complies with all applicable laws and regulations
  • You have appropriate insurance coverage for your property

7. Guest Data and Privacy

You acknowledge that you are a data controller for guest data you collect through the Service. You agree to:

  • Process guest data in compliance with GDPR and applicable privacy laws
  • Only collect data necessary for your legitimate business purposes
  • Inform guests about how their data will be used
  • Respond to guest data access and deletion requests
  • Not sell or share guest data with unauthorized third parties

8. Intellectual Property

The Service and its content, including but not limited to text, graphics, logos, and software, are owned by Guesto and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute our content without permission
  • Use our trademarks without written consent
  • Reverse engineer or decompile our software

You retain ownership of content you upload to the Service, but grant us a license to use it for providing the Service.

9. Third-Party Services

The Service may integrate with third-party services (e.g., Google, Airbnb, Booking.com). Your use of such services is subject to their own terms and privacy policies. We are not responsible for third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted or error-free
  • The Service will meet your specific requirements
  • Any errors in the Service will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUESTO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Business interruption
  • Damages arising from your use of or inability to use the Service

Our total liability shall not exceed the amount you paid to use the Service (if any) in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Guesto and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you upload to the Service

13. Account Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion.

Upon termination, your right to use the Service will immediately cease. You may request deletion of your data in accordance with our Privacy Policy.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the member state where Guesto is established, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
